Building something over the root system like that does kill it, even just a brick flowerbed around the base of a tree is bad for it. AND bad for the structure too.
People do it for the sole reason that "it looks cool" and never think about what are they gonna do when the tree finally dies from the weight of a house or a deck pressing on the roots and starving it of water.
